This is on every pesticide label “DIRECTIONS FOR USE”
“It is a violation of Federal law to use this product in a manner inconsistent
with its labeling.”
But what does it mean?
The label is the law, if you use that product in any other way other than what is specified on that label, you are in violation of Federal Law and could be fined or imprisoned or both. If you are an unlicensed untrained user of the pesticide and you apply it to commercial structure you could be violating state and federal laws and not even know, because you placed other people at risk unforgettably for you ignorance is no excuse for the law.
Using the same product in same way from a residential, exterior, broadcast way into an interior commercial food establishment could violate the law cause serious contamination to surfaces and food and put the public at risk.
Case Study:
The US Department of Justice website United States v. Bio-Tech Management Inc.
The indictment states that From October 2005 – through June 2009, Steven Murray directed the technicians of Bio-Tech Management Inc., to use Termidor indoors in nursing homes which is contrary to the label which is a violation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
It was only after the Georgia Department of Agriculture inquired that Murray told several of his employees make changes in the service reports in an effort to cover up the misuse of Termidor. Both Steven Murray and Bio-Tech pleaded guilty to conspiracy, FIFRA violations, false statements, and mail fraud.
Murray was sentenced to 24 months of prison fined $7,500 fine, Bio-Tech was fined $50,000 3 years of probation.
